Why should I go to Court and what should I do if I missed a Court date?

If you have been sued it is incredibly important you participate in the Court process, ideally with an attorney. In Illinois, once you have been served with a lawsuit, you usually only have 30 days to retain an attorney or file your own pro se appearance in the Court. If you do not, then the person or entity suing you may be entitled to a “default judgment.” A default judgment is an automatic win for the Plaintiff and does not necessarily require that the Plaintiff present any evidence of your guilt or liability.

For example, if someone says you owe them $1,000.00 dollars, and you do not go to Court, then they may get a default judgment even if the evidence actually shows that you do not owe them any money. This also means that the collection process can start immediately. Collections can result in your bank accounts being frozen, money being deducted or even your pay being garnished, all because you did not go to Court or get an attorney.

It is important that you speak to an attorney as soon as possible. If you want your case decided on the evidence and merits, you must participate in the process.
